General Terms and Conditions
Full Out Camp Dance Residence Programme

By submitting a completed application form via www.fulloutcamp.cz the participant enters into a contract for the provision of services, consents to the General Terms and Conditions, and confirms that he/she has read them and agree with them.

The General Terms and Conditions (hereinafter "GTC") govern the legal relationship between Movement Factory, z.s., ID: 08 622 396, with registered offices at Malé náměstí 76, Veselí nad Lužnicí II, 391 81 Veselí nad Lužnicí (hereinafter the "Promoter") and the participant or their legal guardian, (hereinafter the "Participant") that follows from the contract on the provision of services, or registration for Full Out
Camp (hereinafter "FOC"). The GTC govern the mutual rights and obligations of the Promoter and the Participant in relation to FOC.

1 BASIC DEFINITIONS
1.1. Full Out Camp (FOC) is a dance residency programme with international instructors held on dates specified on the www.fulloutcamp.cz website, intended for individual dancers and dance groups.
1.2. FOC is organized by Movement Factory, ID: 08 622 3964, with registered offices at Malé náměstí 76, Veselí nad Lužnicí II, 391 81 Veselí nad Lužnicí, registered in the Commercial Register maintained by the Regional Court in České Budějovice under file No L 8442/KSCB.
1.3. A participant is defined as a dancer (or their legal guardian) who has duly completed and submitted an application for participation in FOC.
1.4. The FOC Rules are the operating rules available at www.fulloutcamp.cz, which every Participant must follow.

2 REGISTRATION
2.1. The Participant registers for FOC solely through a duly completed and submitted registration form available on-line at www.fulloutcamp.cz. A duly completed and submitted registration form is binding on the Participant. Registration is valid the moment the registration form has been sent, and hence it is not the case that it is only comes into force after the agreed amount has been paid. If capacity has been reached, the payment date is taken into account.
2.2. By submitting the registration form, the Participant confirms that they have read these General Terms and Condition in full and that they agree with them fully and without reservation. These General Terms and Conditions are an integral part of the contract on the provision of services.
2.3. By submitting the application, the Participant also confirms that they have read the FOC Rules fully and in detail, and that they are sufficiently familiar with their state of health, which must fully permit participation in FOC.
2.4. After the registration form has been sent, a contract on the provision of services is concluded between the Promoter and the Participant, through which the Participant undertakes to comply with these GTC. After the Promoter has received the registration form, he shall send the Participant an order confirmation.
2.5. The contract concerns the Promoter's obligation to ensure dance instruction services or other services pursuant to the FOC programme published on the website and the Participant's corresponding obligation to pay the Promoter the agreed price for these services.

3 TERMS OF PAYMENT
3.1. The price of participation in FOC is €739 for juniors and €769 for adults. The total price comprises a non-refundable deposit of €380 and a remainder of €359 for juniors and €389 for adults. Discounts for partner studios are negotiated on an individual basis. The non-refundable reservation fee can be refunded if the event is cancelled based on a government order related to the Covid-19 pandemic, or if you cancel your participation and find a substitute.
3.2. Upon receiving confirmation from the Promoter pursuant to Article 2.4 of these GTC, the Participant shall pay the non-refundable deposit according to payment instructions in the confirmation. If the Participant needs to extend the due date, he or she shall contact the Promoter at info@fulloutcamp.cz.
3.3. The Participant shall pay the remainder by 30 April according to the Promoter's instructions. If registration takes place between 1 May and 15 July, the Participant shall pay the entire amount within 14 days.
3.4. If the Participant fails to pay the remainder by the stipulated deadline, the Promoter shall ask him/her in writing to pay the remainder by a reasonable extended deadline. if the Participant does not pay the remainder even by this extended deadline, the Promoter has the right to cancel the Participant's registration and
charge a cancellation fee pursuant to Article 4 of the GTC.

4 CANCELLATION POLICY
4.1. The Participant has the right to cancel registration at any time prior to the start of FOC in writing through an email sent to the address info@fulloutcamp.cz, subject to the cancellation terms below.
4.2. If the Participant cancels their registration or if registration is cancelled pursuant to Article 3.4, the Participant must pay a cancellation fee that varies depending on the time left until FOC starts, as follows:
20 % of the remainder if cancellation occurs 89 – 60 prior to the start of FOC;
50 % of the remainder if cancellation occurs 59 – 30 prior to the start of FOC;
80 % of the remainder if cancellation occurs 29 or less days prior to the start of FOC;
100 % of the remainder if cancellation occurs from 7 prior to the start of FOC to the end of FOC.
4.3. The Participant shall pay the cancellation fee according to instructions from the Promoter. If the Participant has already paid the remainder, the Promoter will return the remainder minus the cancellation fee. The non-refundable deposit is forfeited and is kept by the Promoter.
4.4. The obligation to pay a cancellation fee does not apply to cases when the Participant finds a substitute who assumes the contractual relationship in his or her stead; in doing so he or she is obliged to inform the Promoter of this fact without undue delay. The obligation to pay a cancellation fee also does not apply to cases described in Articles 4.4 and 4.5.
4.5. Insurance for cancellation due to illness or injury. The Participant can, upon his or her own discretion, take out insurance for cancellation due to illness or injury, which applies in case of cancellation due to illness or injury prior to the start of FOC. The price of this insurance is CZK 500. If insurance for cancellation due to illness or injury istaken out, the Promoter shall refund the Participant the entire remainder paid if the cancellation occurs prior to the start of the event. The Participant must provide a medical report prior to the start of the event.
4.6. Insurance for cancellation without providing a reason. The Participant can, upon his or her own discretion, take out cancellation insurance without giving a reason, which applies in case of cancellation of participation in FOC. The price of this insurance is CZK 990. If insurance for cancellation without giving a reason is taken out, the Promoter shall refund to the Participant:
- the entire paid remainder and the deposit of CZK 8890 if the cancellation occurs prior to the start of FOC;
- the entire paid remainder and forfeit of the deposit of CZK 8890 if the cancellation occurs less than 14 days prior to the start of FOC.
 
5. TERMS AND CONDITIONS OF THE SERVICE
5.1. The Participant is obliged to read the FOC Rules prior to participating in FOC.
5.2. The Promoter reserves the right to make changes in the agreed services, including substitution of instructors. In this case, the Promoter must inform the Participant of such changes without undue delay.
5.3. If FOC cannot take place due to force majeure, the Promoter has the right to not hold FOC or end it prematurely without the right to a refund.
5.4. If a Participant provides untrue or incomplete personal information, the Promoter has the right to withdraw from the contract with the given Participant, meaning cancellation of their participation in FOC under the terms of the cancellation policy in Article 4.
5.5. The Participant must behave in accordance with the FOC Rules for the entire duration of FOC.
5.6. The Promoter has the right to expel the Participant during the course of FOC if the Participant breaches the FOC Rules or due to the Participant's poor health (especially if the health of the Participant poses a risk to other individuals). If the Participant is expelled, the Participant shall bear all costs of the termination of their participation in FOC.
5.7. The Participant must inform the Promoter in writing regarding all known medical restrictions. By submitting the registration form, the Participant confirms that that their state of health allows them to participate in FOC. The Participant shall bear all risks related to aspects of their state of health of which the Promoter was not informed.

6. PARTICIPANTS' PERSONAL INFORMATION
6.1. By submitting the registration form, the Participant authorises the Promoter to process the following personal information:
– the Participant's name, surname, date of birth and address;
– the Participant's email address and phone number;
– the Participant's personal photograph and other photographs of the Participant;– visual and audio-visual recordings showing the Participant;
– any other recordings in which the Participant can be identified;
– data and information contained in obligatory documents (for example health insurance card, confirmation of a child's state of health, confirmation of infection-free status).
6.2. By submitting the application, the Participant also confirms that they have been given information regarding the processing of personal data to the extent required by Regulation No 2016/679 GDPR, as follows:
6.2.1. Legal basis for processing: voluntary consent pursuant to Article 9(2)(a) GDPR;
6.2.2. Category of personal data recipients (processors): The Promoter can delegate the processing of personal data to a third party (a processor), with the current list of third parties being available from the Promoter upon request;
6.2.3. Purpose of personal data processing: FOC administration and organisation, sending of commercial offers from the Promoter and his contractual partners.
6.2.4. Personal data processing period: The duration of the contractual relationship between me and the Promoter and for 10 years from the date of the end of this relationship, unless specified otherwise in a specific instance;
6.2.5. Rights related to the processing of the Participant's personal data:
– the right to withdraw consent to the processing of personal data at any time;
– the right to request access to personal data;
– the right to correct or delete personal data;
– the right to restrict processing;
– the right to object to processing;
– the right to data transferability;
– the right to lodge a complaint with the Office for Personal Data Protection of the Czech Republic.
6.2.6. The Promoter will provide more detailed information regarding the processing of personal data based on a written request sent to the following email address: info@fulloutcamp.cz.
6.3. By submitting the registration form, the Participant authorises the Promoter to make permanent audio, visual, and audio-visual recordings of the Participant, to modify them arbitrarily, and to publish them. The Participant also authorises the Promoter to exercise the right to use these recordings as a whole or in parts, collages, or sequences, as part of a larger whole or individually, in original or modified form, in all methods of use, including authorisation to disseminate such recordings for purposes of promoting the Promoter and his contractual partners (on social networks, the web, posters, billboards, or in advertising, audio, and visual spots, etc.).
6.4. By submitting the application, the Participant explicitly confirms that they have been informed by the Promoter regarding the processing and protection of personal data. The Participant also declares that all data he or she has provided to the Promoter are complete, true and accurate.

7. FINAL PROVISIONS
7.1. These GTC apply as of 1 February 2024.
7.2. The Promoter has the right to change these GTC at any time. The Promoter must always publish the current version of the GTC on his website. A new version of the GTC becomes effective with its publication on the Promoter's website. The Participant is bound by the version of the GTC effective on the date of the creation of the contract on provision of services. If these General Terms and Conditions change after the conclusion of the contract on the provision of services, this change will not affect the rights or obligations of the parties to this contract, but the parties will be able to accede to the new version of the General Terms and Conditions.
7.3. If any provision of these GTC becomes invalid or ineffective, the validity of other provisions remains unaffected as does the validity and efficacy of these GTC as a whole. The contracting parties shall replace the invalid or ineffective provisions of these GTC withe valid or effective provisions that correspond as closely as possible to the sense and purpose of the invalid or ineffective provisions.
7.4. All contractual relationships that follow from these GTC or from the contract on the provision of services between the Promoter and the Participant are governed by generally applicable legislation of the Czech Republic.
